These Terms of Service ("Terms") govern your use of the Real Japan mobile application (the "App") operated by ProductShake ("we", "our", or "us"). By using the App, you agree to these Terms.
Use of the App
We grant you a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes. You agree not to:
- Use the App for any unlawful purpose
- Attempt to gain unauthorized access to the App or its systems
- Interfere with or disrupt the App's functionality
- Copy, modify, or distribute the App's content without permission
User-Generated Content
You may submit reviews and ratings through the App. By submitting content, you:
- Represent that your content is accurate and does not violate any third party's rights
- Grant us a worldwide, royalty-free license to use, display, and distribute your content within the App
- Acknowledge that your reviews will be publicly visible to other users
We reserve the right to remove any content that we determine, in our sole discretion, is inappropriate, offensive, or violates these Terms.
Travel Information Disclaimer
The App provides travel information about attractions in Japan for informational purposes only. We make no guarantees about the accuracy, completeness, or timeliness of this information. Attraction availability, hours, prices, and conditions may change without notice. Always verify important details directly with attractions before visiting.
Intellectual Property
The App, including its design, features, and content (excluding user-submitted reviews), is owned by ProductShake and protected by intellectual property laws. You may not use our trademarks, logos, or other proprietary materials without our prior written consent.
Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PRODUCTSHAKE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP, IF ANY.
Termination
We may terminate or suspend your access to the App at any time, without prior notice, for any reason, including if you violate these Terms. You may stop using the App at any time by uninstalling it from your device.
Changes to Terms
We may update these Terms from time to time. We will notify you of any changes by posting the new Terms in the App and updating the "Effective Date" above. Your continued use of the App after changes constitutes acceptance of the new Terms.
Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of Delaware.
